1. General Terms and Conditions of the www.burinieks.lv Website

Before using the website www.burinieks.lv of SIA “Urbannfresh”, reg. no. 44103096711, address Parka iela 24a-47, Limbaži, LV-4001 (hereinafter referred to as SIA Urbannfresh), please carefully read these terms of use (hereinafter referred to as the Terms).

1.1. SIA Urbannfresh provides the content available on burinieks.lv and offers goods purchasing services in accordance with the Terms and Conditions set out below, delivery terms, goods return terms, the laws in force in the Republic of Latvia, and other regulations, the details of which can be found on burinieks.lv.

1.2. By accessing and/or using burinieks.lv, you confirm that you have read these Terms, that they are understandable to you or your represented person, and that you or your represented person agree to comply with them without restrictions or conditions. From the moment you start using burinieks.lv or perform any actions on it, it will be considered that you are familiar with the terms in force at the time of use and will comply with them. Every burinieks.lv user is obliged to regularly read the Terms to be timely informed about any changes made to them.

1.3. If you do not agree to these Terms, please do not visit or use burinieks.lv, nor use the goods purchasing services and information offered therein.

1.4. SIA Urbannfresh has the right to unilaterally change the content of burinieks.lv and the Terms at any time, and such changes take effect after their publication on the website burinieks.lv.

1.5. Users of burinieks.lv have the right to use the opportunities offered therein and purchase goods and/or services (hereinafter referred to as Products) at the price valid at the time of purchase. SIA Urbannfresh has the right at any time, at its own discretion, to change the prices indicated on burinieks.lv and/or add new Products.

1.6. SIA Urbannfresh does not assume responsibility for any expenses or losses that may arise at any time during the use of the website burinieks.lv.

1.7. If the buyer purchases Products offered on burinieks.lv via the Internet, such a mutual agreement is considered a Distance Contract and is subject to the relevant legal norms regulating Distance Contracts, including but not limited to the Latvian Consumer Rights Protection Law and the Cabinet of Ministers regulations “Regulations on Distance Contracts”.

1.8. The Distance Contract for the purchase of a Product is considered concluded at the moment of payment for the Product.

2. Privacy, Confidentiality and User Data Security:

2.1. SIA Urbannfresh, regarding the processing of personal data, takes all necessary measures to ensure data security in accordance with the General Data Protection Regulation (GDPR) EU2016/679 on the protection of natural persons with regard to the processing of personal data and the free movement of such data. By placing an order on burinieks.lv, the buyer gives their consent for the processing, use, registration, and storage of their data in accounting records in accordance with the applicable legislation.

2.2. What data is collected - When making a purchase on burinieks.lv, SIA Urbannfresh directly obtains the buyer's personal information with the buyer's consent, such as the buyer's name, surname, email address, phone number, and delivery address, which are necessary for order processing and delivery, as well as to provide the best possible service to the buyer. SIA Urbannfresh does not request or process sensitive personal data, only data necessary for the execution of the buyer's order and relevant contractual obligations. Information is also obtained indirectly by using cookies and other technical means to monitor and analyze website usage.

2.3. For what purposes is this data used? The personal data obtained on the website and any additional data provided by the buyer to the seller, if necessary, are used for the following purposes:

2.3.1. For the seller to communicate with the buyer by phone or email;
2.3.2. For processing the buyer's order and fulfilling contractual obligations;
2.3.3. For concluding the relevant contract, if necessary;
2.3.4. For submitting the buyer's application to cooperation credit institutions for purchase on installment.
2.3.5. For preparing purchase-sale and other necessary documents (warranty certificate, contract, registration documents, etc.).
2.3.5. For accounting data records

2.4. Who has access to the collected data and in what cases can it be disclosed to third parties: – SIA Urbannfresh does not use the buyer's data for other purposes than those mentioned in point 12 of these Terms, and does not share the obtained information provided by the buyer online, does not sell or rent the buyer's data to other market participants, and ensures data protection and non-disclosure to other third parties, except for SIA Urbannfresh's cooperation partners and service providers who ensure order delivery, goods financing, and provision of other services to the buyer, to the extent necessary for the fulfillment of contractual obligations. In cases specified by law, SIA Urbannfresh is obliged to disclose personal data to state and municipal officials, law enforcement authorities, or to defend the company's interests, if there is such a necessity and it is required by law.

2.5. How is data stored and for how long? - SIA Urbannfresh takes all necessary measures to ensure the security of buyers' personal data, to protect them from theft, loss, malicious use, as well as unauthorized access, illegal or accidental disclosure, alteration, and other illegal use. Data is stored electronically and in paper format only as long as necessary for the execution of the buyer's order and in the relevant accounting records in accordance with the requirements of the applicable legislation and regulatory enactments.

2.6. What are the buyer's rights regarding their data? – The buyer has the right, by submitting a written request, to perform the following actions:

2.6.1. Access their personal data and receive information about what data has been obtained, when it was obtained and when information was changed, what is the source of data acquisition, for what purpose the personal data processing was carried out, how data is stored, and information about personal data recipients;
2.6.2. Request correction, supplementation, suspension of processing or deletion of personal data if the data is incomplete, false, outdated, or no longer necessary for the original purpose of use;
2.6.3. Request deletion of data at any time.

2.8. If a buyer who has ordered and purchased a Product on burinieks.lv does not have legal capacity or capacity to act, the legal representative of this person (e.g., parents, guardians) is responsible for the submission of personal data, the Product order, and payment. In the aforementioned case, the order is not revocable, and the payment made for the purchase is non-refundable.

3. Cookies

3.1. Cookies are small text files that are created and stored on the Client's device (computer, tablet, mobile phone, etc.) when visiting the burinieks.lv website. Cookies “remember” the user's experience and basic information, thereby improving the convenience of using the burinieks.lv website.
3.2. By using cookies, general user habits and website usage history are processed, problems and deficiencies in the website's operation are diagnosed, user habit statistics are collected, and full and convenient use of the website's functionality is ensured.
3.3. If the Client does not wish to allow the use of cookies, the Client can do so in their browser settings; however, in such a case, the use of the website may be significantly hindered and complicated. Deletion of saved cookies is possible in the browser settings section of your device by deleting the saved cookie history.
3.4. The burinieks.lv website uses functional, analytical, advertising, and mandatory cookies.

4. Warranty

4.1. The range of goods offered by SIA Urbannfresh is created only in cooperation with official representatives or manufacturers of the respective brands.

4.2. All goods offered in the burinieks.lv online store are provided with a warranty in accordance with the laws in force in the Republic of Latvia and the warranty terms developed by the dealer.

4.3. The warranty covers damages caused by manufacturing defects or the quality of raw materials.

4.4. During the warranty period, in case of repair necessity, the product in full set must be delivered to the SIA Urbannfresh store in Valmiera, Garā iela 7 or Cēsis, Piebalgas iela 1a, along with the completed warranty card and documents confirming payment for the product.

4.5. First, the product will be diagnosed at the relevant distributor's/service partner's service, and in the case of a warranty, the damaged parts will be replaced free of charge. If during diagnostics it is found that repair is not possible, the product will be replaced with a new or equivalent one (if the relevant product model is not available at the time).

4.6. The final decision on warranty repair, replacement, or refusal is made by the representative of the relevant distributor, as free warranty repair or product replacement will be carried out in accordance with the manufacturer's or distributor's terms.

4.7. To avoid misunderstandings, please carefully read the product's user manual.

4.8. The warranty does not cover transportation of the product to the service and delivery after repair.

4.9. The warranty is not valid:

· if the damage was caused by improper use, alteration, insufficient maintenance, or careless handling;
· if the damage was caused by failure to follow the instructions in the user manual;
· if the product has been repaired independently or taken to another service before submitting a warranty claim;
· if the products have been used for commercial purposes (e.g., rented out);
· if the damage was caused by water exposure to products not specified as waterproof in the user manual.
· if the damage was caused by fire, flood, earthquake, or other natural disasters.
· if the buyer cannot present a valid receipt or invoice, warranty obligations are voided

4.9. The warranty does not cover normal wear and tear, scratches, and mechanical defects that do not affect the full operation of the product.

4.10. The warranty does not apply to the design elements of the product

5. Product Returns and Refunds

5.1. According to the Cabinet of Ministers Regulations No. 255 of 20 May 2014 “Regulations on Distance Contracts”, the buyer has the right to withdraw from this contract within 14 (fourteen) calendar days without giving any reason and to return the goods purchased in the online store burinieks.lv to the seller.

5.2. The right of withdrawal expires after 14 days from the day the buyer or a third person, who is not the carrier and is indicated by the buyer, has taken possession of the goods.

5.3. To exercise the right of withdrawal, the buyer must inform us, SIA “Urbannfresh”, Parka iela 24a-47, Limbaži, LV-4001, phone number: 29276710, email address: [email protected], about the decision to withdraw from this contract.

5.4. The cost of returning the goods is borne by the buyer.

5.5. The money for the returned goods will be refunded within 10 working days.

5.6. The buyer must return the goods to the burinieks.lv store at Garā iela 7, Valmiera, or Piebalgas iela 1A, Cēsis, without undue delay and in any case no later than 14 days from the day the buyer or a third person, who is not the carrier and is indicated by the buyer, has taken possession of the goods.

5.7. Please note that SIA Urbannfresh will not accept goods returned by mail or parcel machine, as it is not possible for both parties to record possible visual damages and the contents of the set at the time of receipt of the goods.

5.8. By sending goods to the burinieks.lv store using courier service, the buyer agrees to the unilateral determination by SIA Urbannfresh of the visual and technical condition and set of the goods at the time of receipt. Further claims that, in the buyer's opinion, do not correspond to what he/she sent will be considered unfounded, therefore we recommend handing over the goods in person at Garā iela 7, Valmiera, or Piebalgas iela 1A, Cēsis.

The buyer is responsible only for the decrease in the value of the goods if the goods have been used not for determining their nature, characteristics, and functioning, but for other purposes.
During the withdrawal period, the buyer has the right to use the goods only to the extent necessary to determine the nature, characteristics, and functioning of the goods (to the same extent as could be done before purchase in a regular store).
By exercising the right of withdrawal, the buyer is responsible for the use of the goods that exceeds what is necessary for determining the nature, characteristics, and functioning of the goods.
The buyer is responsible for such use of the goods during the withdrawal period that is not compatible with the principle of good faith, as well as for the decrease in the value, quality, and safety of the goods.
The buyer is responsible for maintaining the quality and safety of the goods during the withdrawal period.
www.burinieks.lv reserves the right to refuse the buyer the right of withdrawal or to withhold compensation in case the goods have been used and/or damaged, are not in their original packaging, or the packaging is significantly damaged.

THE CONSUMER CANNOT EXERCISE THE RIGHT OF WITHDRAWAL:

In the cases specified in point 22 of the Cabinet of Ministers Regulations No. 255 of 20 May 2014 “Regulations on Distance Contracts”, including if:

the price of the goods depends on fluctuations in the financial market that the seller cannot control and which may occur within the withdrawal period;
the goods are made according to the consumer's instructions or are clearly personalized;
the goods deteriorate quickly or their expiration date is soon;
the buyer has opened the packaging of an audio or video recording or computer program;
the buyer has opened the packaging of goods which, for health and hygiene reasons, cannot be returned;
the goods, due to their properties, after delivery have irreversibly mixed with other things

6. Payment and Delivery

When placing an order, please indicate your preferred method of payment and receipt of goods. Upon receiving the order, we will confirm it by email or phone and agree on the time for receiving/delivering the goods.

You can pay for goods in the following ways:

by bank card, using the Swedbank payment platform
in cash, upon receiving the goods in our store
by payment card, upon receiving the goods in our store

You can receive the goods in the following ways:

by Omniva.lv parcel machine - after receiving payment in our bank account, we will send your goods via Omniva.lv parcel machine to your indicated parcel machine within one working day. Delivery time is one to two working days. You can view parcel machine addresses here.
by Omniva courier - after receiving payment in our bank account, we will send your goods by Omniva courier to your indicated address within one working day. Delivery time, depending on the delivery location, is one to two working days. The Omniva courier will deliver your order to the specified address, after contacting you and agreeing on the delivery time.
in our store, Garā iela 7, Valmiera - after receiving payment in our bank account, you can receive the goods in our store. If you choose to receive the goods in our store, you can also pay for the goods in cash or by payment card.
in our store, Piebalgas iela 1a, Cēsis - after receiving payment in our bank account, you can receive the goods in our store. If you choose to receive the goods in our store, you can also pay for the goods in cash or by payment card.

- free of charge, by Omniva parcel machine, if the order amount exceeds 50 EUR. More information about Omniva here.

- 3 EUR, by Omniva parcel machine, if the order amount does not exceed 50 EUR

- according to the price list of the chosen delivery provider, courier service provider, if due to the size and/or weight of the goods it is not possible to send by Omniva parcel machine. Delivery costs for each such order are calculated individually, taking into account the size and weight of the ordered goods.
